File EB1 with NIW open file

Is it possible to apply for EB1 at the same time while having an open case with the USCIS? My NIW case was filed last December.

Yes, you can apply for both EB-1 and NIW categories at the same time and proceed with whichever one is finalized first. However, if your Form I-140 and documents are properly filed based on your skills and expertise, there is no need to do this.
